Are employers allowed to require employees to keep their pay confidential?

In Virginia, employers are allowed to require employees to keep their pay confidential. However, Virginia does have some laws in place to protect worker pay secrecy. According to the Virginia General Assembly, employers may not terminate, discipline, or otherwise discriminate against an employee for disclosing or discussing the employee’s wages. In addition, employers are prohibited from taking any retaliatory action against any employee who requests information related to his or her pay or the pay of another employee. With that said, Virginia employers are allowed to ask employees to keep their salaries confidential. Employers can include this requirement in an employment contract, as long as it does not violate any state or federal laws. But some employers may also impose a “gag order” on employees, which requires them to keep not just their salary confidential, but also any information they learn while on the job. It’s important for employees to be aware of the laws in their state when it comes to salary confidentiality before agreeing to any terms of employment.
