What is the eminent domain process?

The eminent domain process is the legal system used in Maine to allow the government to take land from private citizens for public use. This process is also known as condemnation. When the government is interested in taking land through eminent domain, the process is initiated with a notice of intent to take the property. This notice will outline what the property will be used for and what the government is willing to pay in compensation for the land. The property owner then has the right to negotiate with the government over the value of the land, and how the government will use it. During this process, the owner is also able to present alternatives to the proposed use. If an agreement is not reached, the case can go to the Superior Court to be settled. If the court decides to proceed with the taking of the land, the property owner will receive notice of the court’s decision. This notice will include the amount of compensation the owner will receive for their land. At this point, the property will be appraised and assessed and the owner will receive an offer from the government outlining the terms of the taking. Finally, the owner will need to sign a deed of transfer to finalize the eminent domain process and the property will then become government owned. The owner will then be compensated and the government will be able to take possession of the land for its public use.
