What is the eminent domain process?
The eminent domain process in New York is governed by the state’s Eminent Domain Procedure Law (EDPL). This law allows the state or municipalities to take private property for public use if it is for a legitimate public purpose. The process begins with the filing of a petition by the state or a municipality in court. This petition outlines the property to be taken, the public purpose, and the estimated amount of compensation to be offered to the owner. The filing of the petition forms the beginning of the condemnation proceedings. The owner of the property in question must be served with a notice of the petition. They are then given an opportunity to legally challenge the taking of their property. This challenge is called an answer, and it must be filed with the court within a certain period of time. After all of the legal proceedings and hearings have been completed, the court will make a final determination about whether the taking is lawful and what the compensation for the owner should be. If the court finds that the taking is lawful, it will issue a Judgment of Condemnation. This Judgment officially transfers the title of the property to the state or municipality, and the owner must then accept the compensation for the taking of their property. The eminent domain process in New York can be a lengthy and complicated process, and all parties involved should ensure they are familiar with the EDPL and the procedures for condemnation proceedings.
