What is the timeline of the eminent domain process?
In Nebraska, the timeline for the eminent domain process is set out in the Nebraska Expropriation Act. The timeline starts when the condemning agency (the government entity that is taking the property) has filed its petition in the District Court. The Court then issues an order appointing three independent appraisers who will help determine the value of the property. The owner of the property must be served with a copy of the petition and the order regarding the appraisers. They must then be given 30 days to choose an appraiser and serve the original agency with the name of the chosen appraiser. The three appraisers will then inspect the property and one of them is chosen to be the supervising appraiser who will make the report about the value of the property. The supervising appraiser will prepare their report and file it with the Court. The owner of the property is then given 30 days to accept or reject the reported value. If the owner accepts, then the Court will order the sale of the property to the condemning agency. If the owner does not accept the reported value or does not respond within the 30 day period, then the Court will order a trial about the value of the property. The trial will be held before a jury and the jurors will make the final decision about the value of the property. Once the jury has made its decision, the Court will issue an order for the sale of the property to the condemning agency. This process takes several months and can vary depending on the amount of evidence submitted to the Court.
