What is the timeline for payment of compensation for a taking?

The timeline for payment of compensation for a taking in Washington is determined by the type of taking that occurred. Generally, prompt payment of compensation is required in Washington for a taking of property for public use. The condemnor must make the payment within thirty days of the date of the taking. If the property owner does not receive compensation payment within this timeframe, the property owner can file a Petition for Prompt Payment with the condemning agency. In certain circumstances, an agreement between the property owner and the condemning agency may be reached that allows for payment of compensation at a later date. In a case where such an agreement is reached, the compensation payment is typically due one hundred twenty (120) days after the date of the taking. For takings that are preceded by a Measurement and Valuation Hearing, the timeline for payment of compensation is likely to be longer. Hearings are typically used when the parties disagree on the amount of compensation due and require a neutral third party to settle the dispute. After the hearing has taken place and a final ruling on the amount of compensation is made, the payment is due within thirty (30) days of the ruling. If a payment is not received within this timeline, the property owner may file a Petition for Prompt Payment.
