How are relocation costs determined?

Relocation costs in Texas are determined by the scope of eminent domain. Eminent domain is the power of the government to take private property for public use. The Texas Local Government Code states that if an individual is displaced by an eminent domain action, the government must pay just compensation to the individual. The government is required to pay all reasonable costs of relocation. In Texas, relocation costs include the cost of moving all household items, relocation expenses, and the difference between the previous place of residence’s rent and the new place of residence’s rent. In order to determine the cost of moving all household items, the government will consider the size of the residence, the distance of the move, and the cost of packing and unpacking services. Relocation expenses may include travel expenses, temporary lodging, and storage costs. Furthermore, the difference between the former and new residence’s rent will be taken into consideration. The difference between the two will be added to the relocation costs. Once relocation costs have been determined, the government will create a relocation assistance plan. This plan outlines all of the relocation costs and provides the individual with the necessary resources to help with the relocation. It is important to note that these relocation costs are only applicable to individuals who have been displaced by a government action and are not applicable to individuals who are voluntarily relocating.
