What is the difference between a condemnee and a condemnor?
The difference between a condemnee and a condemnor is one of legal roles in eminent domain law. In order for the public authority to legally take the property, it must provide compensation to the property owner. This is the role of the condemnee. The condemnee is the owner of the property, meaning they must accept the payment for the property taken by the condemnor. The condemnee has no choice as to whether or not their property will be taken, but they do have a choice about how much they will be compensated. This is because the condemnee must accept payment from the condemnor and cannot deny the taking of their property. In the long run, it is the condemnor that will benefit from taking the property while it is the condemnee who suffers the consequence of the taking. The condemnee will no longer have legal title to the property and will have to give it up in exchange for the payment made by the condemnor. Ultimately, the condemnor and condemnee have opposing interests in eminent domain proceedings, as the condemnor desires to take the property at the lowest cost while the condemnee desires to receive fair compensation for the property taken.
