What is the minimum wage?

The minimum wage in Florida is $8.46 per hour. This rate was established effective January 1, 2021, and is part of the statewide minimum wage increases that has been happening since 2005. The new minimum wage rate is the result of several actions by the state legislature, including an increase to the minimum wage law in 2019 and another in 2020. This rate is higher than both federal and previous state minimum wage laws in Florida. Employers in Florida are required to pay employees at least the minimum wage rate established by the state legislature. This includes tipped occupations, like waiters and bartenders, where their minimum wage rate is $5.44 per hour. The tipped minimum wage rate increases with the minimum wage rate. The new minimum wage rate applies to all employees and employers throughout the state of Florida, with the exception of agricultural workers. Employers must also adhere to posting requirements which can be found on the Florida Department of Economic Opportunity website. It is important for employers to be aware of updated labor laws and to make sure they are following the most current minimum wage rate, as failure to comply with labor laws can result in serious penalties.
