What are the disability/bereavement rights of an employee?

In Delaware, employees are granted certain disability and bereavement rights. Generally, an employee must be given a reasonable amount of leave for a disability or bereavement. This includes both physical and mental disability, as well as bereavement due to the death of a close relative, such as a spouse or child. For disability, an employee is entitled to reasonable accommodations for their medical condition, including leave. For bereavement, an employee is allowed reasonable leave for funerals or other ceremonies related to a close relative’s death, such as a viewing or memorial service. An employer must also allow reasonable leave for attending to any affairs related to the death, such as settling the estate of the deceased. In Delaware, employers are generally required to provide a reasonable amount of leave for disability and bereavement. An employer should be willing to work with an employee to ensure that the employee is able to meet their needs without compromising their job duties. If an employer fails to provide a reasonable amount of leave for these events, they may be subject to legal action.
