Are employers allowed to request personal information from job applicants?
In Indiana, employers are allowed to ask for certain types of personal information from job applicants, but there are limits. Employers are prohibited from asking questions about an applicant’s race, color, national origin, gender, pregnancy, religion, age, disability, or genetic information. They are also prohibited from asking questions about an applicant’s criminal background or financial status. Additionally, employers may not discriminate against applicants on the basis of their membership in a protected class. Employers may ask job applicants to provide information such as previous employment history, educational background, and contact information. Employers may also require a job applicant to complete a job application and/or resume, and may ask questions to verify the accuracy of the information provided. Employers may also request an applicant’s references. However, employers must inform applicants of the reasons for requesting the information and may not ask applicants to provide more information than is necessary to assess their suitability for the job. Overall, employers are allowed to ask for information from job applicants, but they must ensure that they are not discriminating against applicants or asking for information that is not directly related to the job. Employers must also ensure that they are treating all applicants equally and fairly.
