What is the difference between constructive dismissal and wrongful dismissal?
Constructive dismissal and wrongful dismissal are two terms used in employment law in Mississippi. Constructive dismissal occurs when an employer makes significant changes to an employee’s job responsibilities, pay, or work environment that the employee did not agree to, which eventually leads the employee to resign. This can include being demoted or being required to take on more work than planned. In this situation, the employer is technically not firing the employee, but they are creating conditions so unpleasant that the employee has no choice but to resign. Wrongful dismissal, on the other hand, occurs when an employer directly terminates an employee without just cause. This can include firing someone when they have done nothing wrong or when the employer does not follow the right procedures. In Mississippi, an employee can challenge their wrongful dismissal in court and claim damages. The two terms are distinct because constructive dismissal is when the employer forces the employee to resign, while wrongful dismissal is when the employer terminates the employee directly. It is important to remember that there can be overlap in certain cases where the employer’s actions create an environment so hostile that the employee resigns, making it a case of constructive dismissal.
