What is a publishing deal?

A publishing deal is an agreement between a songwriter or composer and a music publisher. The music publisher provides the songwriter or composer with financial or career advancement to help promote the song or composition. In return, the music publisher obtains the right to exploit the song or composition. In Washington, this means that the music publisher can license the song or composition to third-party entities such as radio stations, TV networks, and movie producers for use in film and television. Additionally, the music publisher is responsible for collecting royalties from any US sales or performances of the song or composition. A publishing agreement typically includes a royalty advance from the music publisher to the songwriter or composer and a share of the publisher’s income from the exploitation of the song or composition. The publishing agreement is an important part of the entertainment law in Washington and should always be carefully reviewed by a licensed entertainment lawyer.
