What is a talent contract?

A talent contract is a legal agreement between a person or business (known as the talent) and an employer or organization (known as the employer). The contract defines the duties and responsibilities of each party, including any compensation, royalties, and credits involved in the agreement. In West Virginia, talent contracts must be in writing and must be approved by both parties before any work may begin. These contracts are legally binding and cannot be changed without the agreement of both parties. All talent contracts must include the parties’ names, addresses, and full details about the agreement including services to be rendered, payment amounts, any royalties or additional considerations, and how the contract may be terminated. The talent contract also provides protection to the talent in the case of any complaints or disputes. The employer is responsible for honoring all of the terms of the contract and for compensating the talent accordingly. Any talent contracts that are signed by individuals under the age of 18 must be approved by a parent or legal guardian. Additionally, artists who are minors may only agree to contracts that are limited in scope and duration.
