What is the process for registering a trademark?
Trademark registration in Arizona starts with filing an application with the United States Patent and Trademark Office (USPTO). Your application must include a detailed description of the product or service; the trademark name, logo, or symbol; and the reason for registration. The USPTO will then review the application and determine whether it is eligible for registration. If it is eligible, the USPTO will issue a Certificate of Registration. Once registered, it is important to keep the trademark active and enforceable. To do this, you must always affix the proper trademark symbols (i.e., ™ or ®) to the product or service, monitor possible infringements, and actively police the trademark. You must also renew the trademark with the USPTO every ten years. During the renewal process, you must a submit a Declaration of Use and Renewal that states the trademark is still in use and renew your Certificate of Registration. Finally, you should register the trademark through the Arizona Secretary of State. This is an additional and separate process that provides additional protection and allows for enforcement of the trademark in Arizona. By carefully following the steps outlined above, you can ensure that your trademark is properly registered and enforced in Arizona and the United States.
