What are the legal requirements for a sponsorship agreement?
In Washington, sponsoring an artist involves a legally binding agreement between two parties: the sponsor and the artist. This agreement outlines the responsibilities of each party and sets the expectations of the relationship. The legal requirements of a sponsorship agreement all depend on the type of agreement. Generally, there are two types of sponsorship agreements: merchandise sponsorship and monetary sponsorship. With a merchandise sponsorship, the sponsor provides the artist with items, such as clothing, to be seen while performing or appearing in public. In return, the artist will promote the sponsor’s products. There must be a written agreement in place outlining the relationship and any compensation the artist may receive, as well as protections for the sponsor’s products. With a monetary sponsorship, the sponsor provides money in exchange for the rights to use the artist’s name, performance, and/or image. Again, this must be in writing and should include particulars on the amount to be paid, when it should be paid, and the time frame of the relationship. It should also cover any associated costs, such as royalties, or whether the artist will be expected to do any promotional activities. Ultimately, it’s important to ensure that both parties are protected when creating a sponsorship agreement. It should be thoroughly reviewed by a lawyer specializing in entertainment law before both parties sign.
