What is a model release form, and what are its legal requirements?
A model release form is a contract between a model and a photographer, production company, or publisher that grants them permission to use the model’s image. It includes a written agreement outlining the details of the image usage, such as how long the image may be used, how it may be used, and the rights the model is giving up to the photographer or publisher. In Florida, it is legally required that any person or organization using a model’s likeness must have a valid release form signed by the model, parent, or legal guardian. This is to ensure that the model is adequately compensated, as well as to protect the model from any potential legal entanglements. The release form must contain the model’s full name, address, and signature; the signature of the photographer, publisher, or production company; the purpose of the image’s use; and a full description of the rights being granted by the model. In addition, the model must be at least 18 years old in Florida in order to sign the release form. If the model is not yet 18, the parent or legal guardian must sign the form on the model’s behalf. Once the form is signed, the model is entitled to a percentage of any sales or royalties made from the image. Model release forms are legally required in Florida and are essential for protecting the rights of the model. By signing a model release form, the model is agreeing to grant certain rights to the photographer or publisher, and is assured of being compensated in some way for the use of their image.
