What are the legal requirements for a management agreement?
In Florida, a management agreement is a legally binding contract between a musician or entertainer, and a manager. This agreement outlines the rights, responsibilities, and expectations of both parties involved. Generally, a management agreement will specify the services the manager is responsible for providing, the scope of the manager’s authority, and the period of time the agreement will be in effect. Other common elements of a management agreement include the compensation the manager will receive for their services, any termination or renewal of the agreement, and any exclusivity clauses that prohibit either party from entering into similar agreements with other individuals or agencies. It is also important that the contract include provisions that protect both parties in the event of a dispute. The management agreement should be written and signed by both parties. Depending on the type of management agreement, it may also be necessary to file documentation and acquire a license from a local licensing agency. In Florida, these documents must be filed with the Clerk of the Circuit Court in the county where the business is located.
