What is the Solid Waste Disposal Act?

The South Carolina Solid Waste Disposal Act (SWDA) is a state law that sets regulations pertaining to the disposal of solid waste. The SWDA applies to all businesses, industries, or individuals who generate, transport, dispose of, or handle solid waste in South Carolina. It requires that all solid waste disposal operations be conducted in accordance with regulations issued by the State Department of Health and Environmental Control (DHEC). The regulations set forth requirements for proper disposal of solid waste at landfills, incinerators, and composting facilities. The SWDA is designed to reduce the amount of solid waste going to landfills, reduce water and air pollution, and ensure that solid waste is properly disposed of in an environmentally friendly way. The law also promotes recycling, composting, and other methods of reducing waste. To this end, the law requires businesses to develop and implement waste management plans that include recycling, composting, and other waste reduction strategies. The law also sets standards for the construction and operation of landfills and other solid waste disposal sites. The SWDA is enforced by the DHEC, which inspects solid waste facilities and investigates citizen complaints about improper disposal. The DHEC can issue civil penalties for violations of the law. The DHEC also works with businesses to ensure they are meeting their waste management obligations. The law also authorizes citizen suits, allowing citizens to take legal action against businesses that violate the SWDA.
