Are there different types of ownership for horses?
Yes, there are different types of ownership for horses in Texas. Ownership of horses is classified as either private or public. Private ownership is when an individual or entity possess the horse and exercises control, custody, and possession, or title of the horse. Public ownership is when the title to a horse is held by a municipality or public entity, or a horse is under the supervision of a governmental agency, such as a state or federal agency. One type of private ownership is called full ownership, which is the total ownership of a horse. This includes the right to use the horse, including its sale, destruction, or other dispositions. Partial ownership occurs when two or more people share the right to use the horse. This includes the right to transfer its ownership, use, possession, control, and title. Another type of private ownership is joint ownership or co-ownership, which occurs when two or more people share the right to use the horse while sharing its ownership and title. Each co-owner is considered an owner and has the right to use or dispose of the horse without the consent of the other co-owners. Finally, there can be ownership though a lien or lease. A lien is when a horse is purchased but not fully paid for and the seller retains ownership of the horse until it is fully paid for. In a lease, the owner of the horse (lessor) grants the right to use the horse for a certain amount of time to another person (lessee), with the lessor still maintaining ownership.
