What is equine activity liability?
Equine activity liability is a legal concept that is relevant to equine law in the state of New York. This concept is based around the idea that people involved in the equine industry have a responsibility to take reasonable steps to ensure the safety of others. It is a part of what is known as the “duty of care” in equine law. In New York, equine activity liability is based on a concept called “assumption of risk”. This means that if someone is engaging in an activity that carries a certain risk, and they knowingly accept that risk, then they cannot sue for damages in the event of an injury even if the activity was not conducted safely. There are, however, some exceptions to this rule. If the activity was unreasonably dangerous, or if the person who was injured was not aware of the risk or was too young to properly assess it, then equine activity liability may apply. In these cases, it is possible to sue for damages incurred due to the negligence of the person or organization responsible for the activity. Overall, equine activity liability is an important concept to understand in equine law in the state of New York. It is important to be aware of the risks involved in any equine activity and to take reasonable steps to ensure the safety of yourself and others.
