What is a durable power of attorney?
A durable power of attorney is a legal document in California that allows a person to appoint an individual, known as an agent or attorney-in-fact, to manage their finances and make decisions on their behalf. A durable power of attorney is an important part of estate planning in California and allows a person to plan for the future in the event that they become incapacitated or incapacitated due to an injury, illness, or death. The person who appoints the agent is known as the principal while the agent is responsible for making decisions related to the principal’s financial matters. This includes decisions such as investment decisions, real estate transactions, and healthcare decisions. The principal can be as specific or broad as necessary in stipulating the powers of the attorney-in-fact and can revoke the powers at any time. The durable power of attorney is different from a standard power of attorney in that it does not end upon the principal’s death or incapacity. This is why it is so important to designate a durable power of attorney as part of your estate plan in California. With a durable power of attorney in place, the appointed agent can continue to make decisions on the principal’s behalf if they become incapacitated or die.
