What is an advance health care directive?

An advance health care directive is a legal document used in estate planning in Florida. It is a voluntary document that allows a person to give instructions about any future medical care the person wishes to receive. It is sometimes referred to as a “living will” because it is active while the person is alive. The directive can cover a range of topics such as who should make medical decisions on the person’s behalf if they become incapacitated or unable to make decisions themselves, what type of medical care should be given in specific medical situations, and what should happen to the person’s body after death. In the state of Florida, an advance health care directive also allows the person to designate one or more people to be responsible for the decisions and any other matters related with health care. This person is referred to as the “proxy” or “agent” which must be someone who is trusted by the person. A legally valid advance health care directive must be written, dated, and either signed by the person or another suitable witness. Some states in the U.S. have more stipulations for an advance health care directive, but in the state of Florida, the requirements are relatively simple. An advance health care directive is an important document for estate planning in Florida and can provide peace of mind for individuals when it comes to making decisions about their health care.
