What is an advance health care directive?

An Advance Health Care Directive, sometimes referred to as a Living Will, is an important document that allows an individual to express their wishes regarding medical care in the event they are unable to communicate those wishes. This document, which is only effective when a person becomes incapacitated, is used to designate a person or persons to make healthcare decisions for a person in the event they are unable to make those decisions. This document can also be used to provide instructions regarding treatments that the individual may or may not want in specific medical situations. In Georgia, the Advance Health Care Directive is a legally enforceable document and must be completed according to the laws of the state. The document must be signed in the presence of two witnesses. Once the document is signed, it becomes legally binding immediately, meaning that a doctor or healthcare provider must adhere to the wishes of the person in the document. The Advance Health Care Directive is an important document for people who wish to have a voice in the medical care they receive, even when they are unable to make decisions for themselves. It is also an important document in Estate Planning Law in Georgia, as it can ensure the wishes of an individual are honored even after their death.
