In Maryland, registering an estate plan with the appropriate court or office can be done by filing either a will or a living trust with the Circuit Court of the county where you live. If you are filing a will, it must be accompanied by an Affidavit of Execution, signed by two witnesses who attest that you signed it in their presence. If you are creating a living trust, you should file a copy of the trust with the Circuit Court in the county where you live, along with a Notice of Trust and a Certificate of Trust. The Notice of Trust must be signed by the settlor (the person who created the trust) and the trustee (the person who is in charge of managing the trust). Once documents have been filed with the court, they become a matter of public record. The court clerk should also provide you with a certified copy of the filed documents. This certified copy should be kept in a secure place, as it is proof of the state of the estate plan at the time of filing.
