What is a trust protector and how does it work?
A trust protector is an individual or entity who is appointed to oversee a trust. In West Virginia, a trust protector is responsible for making sure that the terms of the trust are followed and that any amendments to the trust are appropriate and legally permissible. The trust protector may also have the authority to remove trustees or appoint new trustees in certain situations. Trust protectors typically have three basic duties. First, they must ensure compliance with the trust documents and monitor the trustee’s performance. Trust protectors also have the authority to amend the trust documents in certain cases. Finally, trust protectors can remove or replace trustees if they are not properly fulfilling their duties. Trust protectors are generally chosen due to their financial expertise and knowledge of trust law. They are often appointed by the trust creator, or settlor, in the trust documents, but are not related to the settlor. A trust protector is usually compensated for their services. Trust protectors can provide an additional level of security for assets in the trust. They act as an impartial third party to ensure that the trust’s terms are properly executed and that the trust remains compliant with all applicable laws. In addition, trust protectors offer assurance to trust beneficiaries that their interests will be protected.
