What is a Living Will and how does it work?
A living will is an important part of estate planning law in Utah. It is a legally binding document that provides direction on your wishes for medical care should you become unable to yourself make those decisions. It lets people make decisions on what kind of medical care they want and don’t want, and it gives instructions to medical personnel on what treatments or procedures should be done in certain situations. A living will is typically written when you are healthy and of sound mind so that those decisions are fully and properly considered before you become unable to do so. This document outlines what medical treatments and procedure you wish to receive, such as life-sustaining treatments, and which ones you don’t wish to receive, such as feeding tubes or respirators. Should you become unable to make those decisions yourself, your living will is there to help guide your family and medical team as to what you would have wanted. Living wills also help make sure that your wishes for medical care are honored. Without a living will, your family may be at the difficult position of making decisions that run counter to what you would have wanted. Having a living will in place ensures that you are still able to direct your medical care after you are no longer able to make decisions yourself.
