What is a health care directive and how does it work?
A health care directive is a legal document created by a person (known as the principal) which puts into effect their wishes in regards to healthcare if they are unable to make decisions for themselves. The directive writes out what kind of care the principal desires to receive should they become incapacitated or are unable to communicate their wishes. In California, this document is also known as an Advance Health Care Directive, and it can be created with the help of a qualified estate planning lawyer. The document specifies the principal’s wishes regarding the kinds of medical treatment they do or don’t want to receive, as well as instructions for end-of-life care if the principal becomes terminally ill or enters a persistent vegetative state. It also allows the principal to appoint someone to make healthcare decisions on their behalf. This person is known as an agent, or healthcare proxy. When creating an Advance Health Care Directive, it’s important to make sure that your wishes are clearly written down and that you have discussed your wishes with your healthcare proxy. It’s also important to sign the document in front of two witnesses and a notary. Once your document is complete, you can feel confident that your wishes will be honored if you are ever unable to make healthcare decisions for yourself.
