What is a transfer on death deed and how does it work?

A transfer on death deed (TODD) is an estate planning law in Arizona that allows real estate owners to transfer their real property to another person without going through the probate process. Transfer on death deeds are revocable, so the owner can change or revoke the deed while they are alive. When the owner of the real estate passes away, the transfer on death deed will take effect. The deed will need to be filed with the county recorder’s office in the county in which the real estate is located. Once that is done, the real property will automatically be transferred to the person designated in the TODD, without going to court or having to go through the probate process. The person that was named in the TODD will be the new owner of the real property. They will be responsible for paying any taxes or fees associated with the transfer, such as real estate taxes. They will also be required to maintain any mortgages, liens, or other obligations that were on the current owner’s title. Transfer on death deeds are a useful tool for Arizona estate planning law. They allow people to transfer real estate after they have passed away, without having to go through a lengthy and expensive probate process. They also make it easier for the new owner to take possession of the real property, since there is no need to file any additional paperwork with the court.
