What are the common issues addressed in family law?
Family law in North Carolina pertains to matters related to a family’s legal rights and obligations. These issues can range from the dissolution of a marriage or partnership to the adoption of a child. Other common family law issues include child support, spousal support, parenting plans, custody and visitation rights, pre-nuptial agreements, and more. In regards to divorce, North Carolina recognizes both no-fault and fault-based divorce cases. No-fault divorces are often easier to obtain since they do not require either party to prove that the other was at fault for the relationship’s failure. In a fault-based divorce, the court may weigh factors such as adultery or cruelty when determining the terms of the divorce. Child support is a very common area of family law that can be quite complicated. North Carolina has several guidelines in place to help determine what an appropriate level of child support will be, including the parent’s respective incomes, the number of children involved, and whether any childcare costs are incurred. Custody and visitation rights are also commonly addressed in family law. Parents must determine who will have physical and legal custody of the child or children, and what sort of visitation rights the non-custodial parent will have. This can be a complicated process, but the court can help ensure that both parents’ rights are considered and that a fair arrangement is reached. Overall, family law covers a broad range of issues that can be very complex. It is important to consult with an experienced family law attorney to ensure that all of the relevant legal issues are handled properly.
