What is joint physical custody?

Joint physical custody is a family law concept that refers to the arrangement that two parents make to share the physical or living custody of their children. Joint physical custody allows both parents to have an equal or near-equal amount of time with the children, often alternating periods of sole custody on a weekly or monthly basis. This arrangement is intended to give the children a greater sense of stability and allow them to maintain strong relationships with both parents. In Oregon, a court will consider a joint physical custody arrangement if it best suits the interest of the children and serves the parents’ interests. All forms of physical custody can be joint, meaning that the parents can split the physical custody of the children in a variety of ways. One form of joint physical custody, referred to as “50/50,” allows the parents to share equal fractions of physical custody time. This type of arrangement allows the children to have nearly the same amount of time with each parent, usually spending at least one week with each parent each month. In Oregon, the court also considers the parents’ willingness to cooperate and communicate in determining whether joint physical custody is a viable option. The court attempts to ensure that parents who opt for joint physical custody can cooperate and make mutually beneficial decisions regarding the care of their child.
