What is the legal definition of marriage?

In West Virginia, marriage is legally defined as the union of a man and a woman who are legally capable and consenting to the marriage. Marriage is a contract that creates mutual legal obligations between a couple, and it is recognized by both state and federal law. Marriage is not restricted to any race, religion, or ancestry. Any two persons, regardless of gender, who have met the legal requirements may marry in West Virginia. Additionally, same-sex marriages are legally recognized in West Virginia, as well as in all other states. In West Virginia, the legal age of consent for marriage is eighteen years of age for both men and women. If either party is under the age of eighteen, they must obtain a court order before they can enter into a valid marriage. In order to be eligible for marriage, both parties have to be of sound mind and cannot be related closer than second cousins. A marriage license must be obtained at least three days prior to the wedding ceremony and both parties must be present to sign the license. The marriage must also be officially solemnized by a person licensed to perform marriage ceremonies in West Virginia. Furthermore, the parties must both agree to the marriage in the presence of each other, two witnesses, and the person performing the ceremony. Once the marriage has been solemnized, it is then legally recognized by the state.
