What is a Qualified Domestic Relations Order?

A Qualified Domestic Relations Order (QDRO) is a court order that is used in family law proceedings in Alaska to provide for the division of pension or retirement benefits between two or more parties. A QDRO is also known as a Domestic Relations Order (DRO). QDROs are typically used when two parties are divorcing or when one party has a vested interest in the retirement funds of another party. When entering a QDRO, the court orders that a portion of the retirement funds be directed to a separate account for the benefit of the other party. QDROs are specific and must meet certain criteria. The court must identify the retirement plan, specify the amount or percentages to which each party is entitled, and describe the type of payment each party should receive. The order must also include information related to the marriage or divorce, such as the length of the marriage, date of separation, and date of divorce. In addition to the division of retirement benefits, a QDRO can also be used to divide other assets, such as insurance benefits or real estate. A QDRO must be crafted carefully in order for it to be enforceable. It is important to work with a qualified attorney to ensure that the order conforms with applicable laws.
