What is an interstate custody dispute?

An interstate custody dispute is a conflict that arises when two different states are involved in deciding the custody of a minor child. The conflict often arises because each state has their own laws and procedures for dealing with child custody disputes. It’s a common problem that can arise in divorce cases or when one parent relocates to a different state. The two states involved in an interstate custody dispute must each make a determination of legal custody, which is the right to make decisions on behalf of the child. The court in the home state usually has authority over the dispute and will make the final decision. The court in the home state may also decide to consider the laws of both states when making its decision. The parent who is not the child’s primary residence must also prove that the child is in danger if they remain in their current residence. This is to ensure that the child’s best interests are put first, and that the move is in the best interest of the child. There are also other factors that the court may evaluate such as the physical, mental and emotional state of the child, the relationship with each parent, and the willingness of each parent to be involved in the child’s life. If the two states involved cannot reach an agreement, then the matter may be submitted to be decided by the U.S. Supreme Court. This is a lengthy and expensive process, so it’s important for parents to attempt to resolve the matter before it reaches the U.S. Supreme Court.
