What is a modification of a parenting plan?
A modification of a parenting plan is when changes are made to an already established parenting plan. In North Carolina, either parent may petition the court to modify a parenting plan. When a court approves a modification, the new parenting plan replaces the old plan. The most common modifications involve changes to child custody and visitation schedules, and the decision-making powers of each parent. Examples of modifications that affect custody arrangements include changing the primary residence of the child, changing shared custody arrangements, or changing the parenting time that one parent gets with the child. Examples of modifications that affect the decision-making power of each parent include changing the primary decision-maker on topics related to the child’s health, education, and welfare. The court will consider any requested modification if it is in the best interests of the child. The court will consider factors such as the child’s safety, the parents’ ability to cooperate with each other, the parents’ ability to provide for the child’s physical and emotional needs, and any other relevant factors to determine if the modification should be made. If a modification is approved, a new parenting plan outlining the changes must be created and approved by the court. Once the new parenting plan has been approved, the parents must abide by the terms of the new plan or face legal consequences.
