What is a modification of a parenting plan?

A parenting plan modification is a legal process in which a court can change the details of a previous court-ordered parenting plan. This would most commonly involve changing the details regarding custody and visitation of a child. In Texas, the court may modify the provisions of a parenting plan if they find that the circumstances of the child or a conservator have materially and substantially changed since the date the prior order was entered. The most common modifications involve changing the visitation time and/or parenting time for a child. A parent might also ask for changes to the custody provisions, such as changing the conservatorship or access to the child. Other modifications parents might request include changing the amount of child support or alimony, as well as provisions regarding health insurance and medical expenses. In some cases, a parent may also request a change in the geographic area in which a parenting plan has been entered. This may happen when one parent moves away from the other, and there is a need to modify the child custody arrangements to accommodate both parents. Any requests to modify a parenting plan must be made through the court system and must be in the best interests of the child. If a court approves a request for modification, then the court will issue an order detailing the modification, which both parents must abide by.
