What is a child relocation case?

A child relocation case is a type of family law case in Washington that involves one parent requesting to move with the child or children to another location. This type of case is especially common when one parent wants to move to a different city, state, or even country and they want to take their child with them. The parent who is requesting the relocation has to prove that the move would be in the best interests of the child, based on factors such as the quality of life, education opportunities, and any family or social connections in the new location. The other parent who does not want the relocation can contest it, and the court would have to decide the outcome of the case. In some instances, the court may grant the relocation request, but also maintain a visitation schedule that allows the non-relocating parent to still maintain a meaningful relationship with their child. This could include visits on holiday or school breaks, phone calls, email, video chat, etc. In a cases where a parent is trying to relocate with a child against the wishes of the other parent, the court may issue a temporary restraining order or injunction that prohibits the parent from taking the child until the court can render a decision.
