How do I file for a restraining order?
In North Carolina, a restraining order, sometimes called a protective order, is an order from a court that prohibits contact between two people. If you are in danger of being harmed due to domestic violence, abuse, or stalking, you may be able to get a restraining order in North Carolina. To file a restraining order, you must go to the Clerk of Superior Court Office or Family Court Office in the county where the abuser lives or where the abuse happened. You will need to fill out a Civil No Contact or Domestic Violence Protective Order form. You do not need a lawyer to do this, but it may be helpful to have one. When you fill out the form, you must explain why you need a restraining order, including the details of the abuse. If possible, you should have evidence of the abuse, such as photographs or police reports. After you fill out the form, a judge will review it and decide whether to grant your request. There are legal consequences for violating a restraining order, so it is important to follow the terms of the order. You should also be aware that you may be able to extend the duration of the restraining order and that you can also get help from local domestic violence support services.
