What is a domestic violence restraining order?

A domestic violence restraining order is a legal order from a court that is designed to protect victims of domestic violence in California. This type of order is also known as a protective order or a restraining order. The purpose of this order is for the court to limit or forbid contact in any form of communication between the accused abuser and the victim. The order will contain a list of specific types of conduct that the accused abuser must refrain from doing. This could include threatening, harassing, or stalking the victim, coming to the victim’s home or place of work, or having any sort of contact with the victim. The accused abuser must also stop any contact with any mutual acquaintances or members of the victim’s family. A restraining order also includes other protections, such as surrendering any weapons and stopping any behavior that is deemed to be an immediate threat against the victim. The order may also have provisions for the abuser to have no contact with any of the victim’s children. The court usually sets a hearing for the domestic violence restraining order. At the hearing, the victim must present evidence of the domestic violence to the court. The victim may also offer witnesses or other evidence to help prove their case in the hearing. After the hearing is over, the court will make a final decision on whether to grant the order.
