What is the difference between a guardianship and a conservatorship?
A guardianship and a conservatorship are two important legal instruments in family law in Texas. The main difference between the two is the purpose of each. A guardianship is used in cases where a minor child or an incapacitated adult needs someone to make decisions for them. The guardian has a legal responsibility to act in the best interests of the person they are appointed to care for. The guardian is responsible for the everyday care and decisions of the person they are caring for. A conservatorship is a legal arrangement where an adult is appointed to manage the finances and legal affairs of another adult who is unable to manage their own affairs due to physical or mental incapacity. The conservator is responsible for managing the assets and making sure the person in their care receives the necessary care and is not taken advantage of. They are not responsible for the day-to-day care or decisions of the person in their care, only for the financial and legal aspects. Both guardianships and conservatorships must be established by a court in Texas and are extremely important when dealing with minors or incapacitated adults. The guardian and the conservator are required to act in the best interest of the person they are appointed to care for and bear the full legal responsibility for their actions.
