How do I appeal a foreclosure decision in court?
In Pennsylvania, if you want to appeal a foreclosure decision in court, you must file a Notice of Appeal with the court’s prothonotary office within 30 days of the court’s final decision. The filing fee and any associated costs must also be paid at the time of filing. Once the Notice of Appeal is filed, the case will be forwarded to the Superior Court in your judicial district. At the Superior Court, you must then file a brief explaining the reasons why you are appealing the foreclosure decision and include a copy of the original court order. This brief is basically your argument for why the lower court’s decision was incorrect and why the decision should be overturned. When your brief is filed with the court, it will be scheduled for an appeal hearing. During the hearing, you will have the opportunity to present your case and any supporting evidence to a panel of judges. At the end of your presentation, the judges will decide whether to uphold or overturn the original foreclosure decision. If you are not satisfied with the appeal court’s decision, you can then appeal the case to the Pennsylvania Supreme Court.
