What is Fair Housing Law?
Fair Housing Law is a set of laws that seek to protect individuals from discrimination when purchasing or renting a home in Massachusetts. It prevents an individual or a group of individuals from being denied access to or exposed to certain types of housing options based on race, color, religion, sex, national origin, familial status, military veteran status and disability. These protections include the right to choose any housing option without facing discrimination or being treated differently than other applicants. In Massachusetts, Fair Housing Law is enforced by the Massachusetts Commission Against Discrimination (MCAD). The MCAD is responsible for investigating complaints of discrimination in sale, rental, and financing of housing, as well as in public accommodations. Victims may choose to file a complaint directly with the MCAD or through a local fair housing organization. Additionally, Fair Housing Law prohibits advertisements that indicate a preference or encourage discrimination on the basis of race, color, religion, sex, national origin, familial status, military veteran status and disability. This includes ads that state "no children," "no pets," or "no students." These laws are essential in ensuring access to safe and affordable housing for all residents of Massachusetts without facing discrimination or unequal treatment.
