What is Fair Housing Law?
Fair Housing Law is legislation enacted in the United States that protects individuals from being discriminated against when they are seeking housing. It is illegal to discriminate against someone on the basis of race, color, religion, national origin, sex, disability, or familial status (having children). In South Dakota, the South Dakota Human Rights Act guarantees all citizens the right to fair housing. The law applies to landlords, banks, lenders, real estate agents, and any other entities involved in the rental, financing, or sale of housing. It also prohibits any unfair practice in the provision of housing services or facilities, or in the access to utilities or other necessary services related to housing. The South Dakota Department of Labor and Regulation enforces the law, and landlords must comply with the act or face penalties. Additionally, the department provides educational resources and materials to help inform landlords, tenants, and members of the public about their rights and obligations under the act.
