Are landlords allowed to ask for proof of citizenship in accordance with Fair Housing Law?
In Indiana, landlords are not allowed to ask for proof of citizenship as part of their qualifying criteria for tenants when renting a property, in accordance with the Fair Housing Law. The law prohibits discrimination based on race, color, religion, national origin, sex, familial status or disability. Asking for proof of citizenship would be seen as discrimination and is prohibited. The Fair Housing Law in Indiana does, however, allow landlords to ask for a valid Social Security number from prospective tenants to ensure they are legally allowed to rent a property within the United States. Additionally, they may also request a valid driver’s license or passport to verify the identity of the person who is applying to rent. It is important for landlords to understand the rights of prospective tenants and to abide by the Fair Housing Law when renting a property. Landlords are obligated to treat each prospective tenant fairly and not subject them to any type of discrimination. By adhering to the Fair Housing Law, landlords can ensure that all tenants feel safe and protected from discrimination and all rental processes are treated fairly.
