What restrictions apply to filing a fire insurance claim?

In North Dakota, those filing a fire insurance claim must comply with the state fire insurance claims law. To start the process, the claimant must provide a written notice to their insurance company including their name and address, the date, time, and location of the fire, the insurance policy number, a description of the damage and the approximate amount of the claim. The claimant must also provide proof of loss including documentation from the fire department or other authority confirming the cause of the fire. The insurance company will appoint an adjuster to review the claim. The adjuster may require further documentation, such as photos or estimates for repairs, before approving the claim. In the event that a dispute arises, North Dakota requires that the claimant and insurance company informally meet and attempt to resolve the issue prior to filing a formal claim. If a resolution is not reached, the claimant can initiate a formal claim in district court or small claims court if the amount of the claim is less than $12,000. Finally, if the claim is approved, North Dakota laws state that the claimant must accept the funds within 60 days of the claim approval. If the claim is not accepted within this time frame, the funds may be void and the claimant must file a new claim.
