How long does it take to settle a fire insurance claim?

The amount of time it takes to settle a fire insurance claim in Tennessee can vary greatly depending on a few factors. If the homeowner is able to provide clear evidence of the loss, the claim can usually be settled within a few days. However, if the cause of the fire is not evident or the claim is contested, it could take much longer to reach a resolution. In Tennessee, the laws concerning fire insurance claims require insurance companies to provide the homeowner with an “affirmative statement” regarding their acceptance or rejection of the claim within 30 days of receiving notice of the loss. The statement must include the reasons for either acceptance or rejection. Insurance companies are also required to make a good-faith effort to respond to all requests for additional information within 20 days. With cooperation from the homeowner and the insurance company, the claim can usually be settled within 120 days. However, if the fire occurred in an area where there is a high volume of claims, the process may take longer due to the backlog of claims. If a dispute arises and the homeowner is not satisfied with the insurance company’s decision, they have the right to file a complaint with the Tennessee Department of Commerce and Insurance. It could then take up to a year to reach a resolution if the case goes to court.
