What types of events are covered under the FMLA?

Under the Family and Medical Leave Act (FMLA), eligible employees are provided with up to 12 weeks of job-protected unpaid leave in a 12-month period for certain events such as birth and adoption of a child, family illness, or a serious medical condition. In addition, employees may also be eligible for leave to take care of a family member or covered military servicemember with a serious medical condition. Employees in New York are provided with the same coverage as employees in other states, with some additional protections. The FMLA in New York covers events including: • The birth or adoption of a child • The illness of an employee or their family member, including mental illness • The serious medical condition of the employee or their family member • Caring for a family member or covered military servicemember with a serious medical condition • Military exigency leave, which is leave taken by an employee who is a spouse, son, daughter, or parent of a military servicemember due to the military servicemember being called to active duty • Military caregiver leave, which is leave taken to care for a covered military servicemember with a serious medical condition • Organ or bone marrow donation Employees are also protected against discrimination or retaliation for taking FMLA leave. Therefore, employers must ensure that their policies and practices comply with the FMLA and provide employees with the necessary protections.
