Can I take FMLA leave for my own medical appointment?

Yes, you can take FMLA leave in North Carolina for your own medical appointment. Under the Family and Medical Leave Act (FMLA), eligible employees may take job-protected, unpaid leave for up to 12 weeks within a 12-month period for any of the following reasons: a serious health condition of the employee, the birth and care of a newborn, the placement of a new adopted or foster child in the home, or to care for an immediate family member with a serious health condition. A “serious health condition” under the act could include medical appointments that the employee needs to attend for the employee’s own care. In order to qualify for FMLA leave in North Carolina, an employee must be employed by the same company for at least 12 months and have worked for the employer at least 1,250 hours in the 12 months prior to the commencement of leave. The employer must have at least 50 employees working within a 75-mile radius. Employers must also provide notice to employees of their entitlements under the FMLA. Employees must also follow certain procedures before taking FMLA leave, including providing advance notice to the employer of the need for FMLA leave. Employees also must provide certain certification from their healthcare provider to certify the need for the leave. Generally, FMLA leave is unpaid, but employees may use where applicable any accrued vacation, sick, compensatory, or parental leave, or any other forms of available leave from their employer for the duration of the leave. Employers must provide the same health benefits for the employee as if the employee had not taken the leave.
