Is an employee required to pay for health benefits while on FMLA leave?
In Wisconsin, an employee is not required to pay for health benefits while on FMLA leave. Under the federal Family and Medical Leave Act (FMLA), employers are required to maintain an employee’s group health insurance coverage during FMLA leave at the same level of coverage and with the same premiums as if the employee had continued to work. However, the employee is responsible for his/her portion of the health insurance premium on any unpaid leave. If an employee is receiving pay during FMLA leave, the employer must continue its existing practice of collecting the premiums directly from the employee or his/her paycheck. However, employees taking unpaid FMLA leave are still responsible for making arrangements to pay their portion of the premium. If an employee fails to make premium payments, the employee may be subject to loss of coverage.
