How long does the foreclosure process take?

In California, the amount of time that a foreclosure process takes depends on a variety of factors. Generally, the foreclosure process begins with the lender contacting the homeowner to let them know that they are in default of the loan. The lender will then typically post a notice of default, which begins a pre-foreclosure period that can last up to 90 days. If the homeowner is unable to work out an agreement with the lender during this period, the lender may initiate foreclosure proceedings. Once foreclosure proceedings begin, the homeowner will typically be given an amount of time by the court to respond and potentially work out an agreement. This is known as the Notice of Sale period, which lasts for 20 days in California. If the homeowner does not respond within this time period, the lender can then proceed to get a judgment of foreclosure from the court, and set the sale date for the property. The sale of the property then must take place within three months of the judgment of foreclosure. In most cases, the whole foreclosure process from the first default notification to the sale of the property will take around five to six months, though there are exceptions. In some cases, the foreclosure process may be longer if the homeowner is able to work out a payment plan with the lender during the pre-foreclosure period or during the sale period.
