How long do I have to stay in my home after a foreclosure?
After a foreclosure in Massachusetts, you generally have the right to stay in your home until a court orders that you leave. However, in some cases, the lender may ask that you vacate the property before a court order is issued. This is called an eviction. The exact amount of time you’ll have to remain in your home depends on the foreclosure process in your area. For example, in most parts of the state, you have the right to remain in your home for up to 30 days after an auction. The Auction Notice typically states the amount of time you have to stay in your home after the auction has taken place. In some areas, the court may issue a Writ of Possession, which gives the lender the right to forcibly remove you from the property. Generally, a Writ of Possession will give you about 10 days after the court orders it to leave the property. If you still refuse to vacate the premises after this 10-day period, local law enforcement may assist in your removal. Your best bet is to talk to a qualified attorney or real estate agent with experience in foreclosure law in Massachusetts. He or she will be able to provide you with more detailed information and guidance about the laws in your particular area of the state.
